1. Acceptance
By downloading, installing or using Zoom Quest ("the app"), you agree to these Terms of Use. If you do not agree, please do not use the app. Your use of the app is also subject to Apple's App Store Terms of Service, including the standard Licensed Application End User Licence Agreement (EULA).
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices that you own or control, for your own non-commercial entertainment, in accordance with these terms and the App Store rules.
3. Your content and photo library
Zoom Quest uses photos from your own library to create gameplay. You are responsible for the photos on your device and for ensuring you have the right to use them. The app processes your photos and their location data on your device only, as described in our Privacy Policy.
4. Acceptable use
You agree not to: reverse engineer, decompile or attempt to extract the source code of the app except where permitted by law; use the app in any unlawful way; or interfere with, disrupt or attempt to gain unauthorised access to any related services, including leaderboards.
5. Leaderboards and fair play
If you use Game Center leaderboards, you agree not to submit scores obtained through cheating, automation or manipulation. We may, where technically possible and in line with Apple's policies, decline to recognise scores that appear to be fraudulent.
6. Availability
The app requires an internet connection and iCloud Photos to function. We do not guarantee that the app will always be available, uninterrupted or error-free, and features may change, be suspended or be withdrawn over time.
7. Intellectual property
The app, its name, logo, design and original content are owned by us or our licensors and are protected by intellectual property laws. These terms do not grant you any rights in our trademarks or branding.
8. Disclaimer of warranties
To the fullest extent permitted by law, the app is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that scoring, distance calculations or location data will be accurate, as these depend on the metadata in your own photos.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss arising from your use of the app. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including under UK consumer law.
10. Changes to these terms
We may update these terms from time to time. The "Last updated" date shows when they were last revised. Continued use of the app after changes take effect means you accept the revised terms.
11. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction, without affecting any statutory rights you have as a consumer in your country of residence.
